4. Limitation of Liability

To the maximum extent permitted by applicable law, Zephyral and its affiliates, instructors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your use or inability to use our services.
4.2 Maximum Liability Cap
In no event shall our total cumulative liability to you for all claims arising from or related to these Terms and Conditions or our services exceed the total amount paid by you to Zephyral in the twelve months preceding the claim, or one hundred euros, whichever is greater.
4.3 Exclusion of Consequential Damages
We shall not be liable for any consequential, indirect, or incidental damages including lost business opportunities, reputational harm, or costs incurred from decisions made based on information provided in our programs. Professional and business decisions remain your sole responsibility.
4.4 Force Majeure
We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, labor disputes, technical failures, or other force majeure events.
5. Legal Information and Dispute Resolution
5.1 Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Cyprus. Any legal action or proceeding arising under these terms shall be brought exclusively in the competent courts of Nicosia, Cyprus, and you consent to the personal jurisdiction of such courts.
5.2 Dispute Resolution Procedures
In the event of any dispute, controversy, or claim arising from these terms:
- • You agree to first attempt resolution through good-faith negotiations with Zephyral
- • If informal resolution fails, you may pursue mediation before initiating formal legal proceedings
- • Any legal action must be commenced within one year of the cause of action arising
- • You waive any right to participate in class action lawsuits against Zephyral
5.3 Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.
